Terms & Conditions

Thank you for your interest in LISA CRM ("LISA CRM", "we" or "us"). By registering an account or accessing any LISA CRM services ("Services") available through the LISA CRM websites and/or mobile application ("App"), you agree to all of the terms and conditions ("Terms") together with any amendments to this Service Agreement ("Agreement"). If you are using the Service on behalf of a company or other entity ("Company"), you agree to all of these Terms on behalf of that company and you represent and warrant that you have the authority to bind the Company to this Agreement. In this case, "you" and "your" refer to you and the Company.

Subscription and pricing

When you register an account, you will receive a free trial period of 14 days (unless otherwise stated) for which no credit card details or payments are required. Your free trial account will expire automatically unless you decide to subscribe. If you no longer wish to use LISA CRM at the end of your free trial period, you do not need to cancel.

If you choose to subscribe, the subscription fee will only be charged in full at the end of the free trial period via credit card or in the currency specified for the selected subscription (unless otherwise agreed at our sole discretion). Your subscription fee remains fixed during your subscription period and includes access to all existing features.

If you pay by credit card, you authorize us to charge your credit card or bank account for all fees due during the subscription period. You also authorize us to use a third party payment processor and consent to the disclosure of your payment information to that third party processor.

Your subscription will automatically renew at the specified amount and frequency according to your selected subscription plan (e.g. monthly, yearly or other period) unless canceled. You may cancel your LISA CRM subscription at any time without penalty after you are no longer billed. If you cancel your subscription, you can continue to use it until the end of your then-current subscription term.

Data and data protection

To register an account, you will need to provide contact information such as your name, email address and phone number as this will be used to verify, secure and access your account. To keep you logged in, we use cookies on the website and similar tokens in the app. Our server software may also store basic technical information, such as your IP address, in memory or logs.

Through LISA CRM services, you have the ability to import and create leads. This leads data, together with the above data and contact information submitted by you or on your behalf to the LISA CRM services, including electronic data and information submitted by you or on your behalf through the use of third party applications, or automatically processed by you or on your behalf by using the LISA CRM services, is referred to herein as "your data".

Your data may be used to deliver, maintain and improve our services, including troubleshooting, data analysis, testing, research, statistical and survey purposes. We may also use your information to contact you and provide you with the services you have requested, develop new services, suggest personally relevant features and keep our services, our business and our users safe and secure.

When required by law, we may disclose your information to respond to subpoenas, court orders or other legal requests; to exercise our legal rights or defend against legal claims; to investigate, prevent or take action regarding illegal activities, suspected fraud or abuse; or to protect our rights and property. We will carefully review all requests to ensure that they are legally valid and limited to the data that law enforcement authorities require for their specific legal purposes.

You have full ownership and control of your data at all times and can delete it at any time. LISA CRM will never sell, share or make your data available to third parties unless it is necessary to do so in order to provide you with the Services, or we are required to do so by law or by valid legal process. We will not retain your information for longer than is necessary for the purposes of this Agreement and for the provision of the Services. We will notify you immediately if we become aware of any breach of any of our obligations in this Agreement.

Aus irgendeinem Grund oder ohne Grund können Sie diese Vereinbarung jederzeit kündigen oder die Löschung aller oder eines Teils Ihrer Daten anfordern, indem Sie uns eine E-Mail an support@lisacrm.de senden, um Ihre Daten und Ihr Servicekonto zu löschen. Soweit zutreffend, werden wir auch alle Dritten, denen Ihre Daten im Rahmen dieser Vereinbarung offengelegt wurden, anweisen, Ihre Daten zu löschen. Gelöschte Informationen können bis zu 90 Tage lang in Backups aufbewahrt werden. Backups sind verschlüsselt und werden nur im Bedarfsfall für die Wiederherstellung bei Katastrophenzugriffen verwendet.

Data security

We use various security measures to keep your data secure. Your data is fully encrypted during transmission (TLS 1.2 over HTTPS) and in the database (256-bit Advanced Encryption Standard). We strive to use the latest technology to keep your data safe and secure.

Account security

LISA CRM offers a secure login process with one-time passwords ("OTP") via email or SMS. You are solely responsible for who has access to your account by restricting access to your computers and devices and with whom you share your OTP code(s) for logins on multiple devices.

Third-party services

Die Dienste umfassen Funktionen und/oder Funktionalitäten, die mit Online-Diensten von Drittanbietern („Drittanbieterdienste“) interoperieren, gemäß Vereinbarungen zwischen LISA CRM und den Betreibern solcher Drittanbieterdienste (solche Vereinbarungen, „Drittanbietervereinbarungen“ und solche Betreiber, „Betreiber“) oder durch Anwendungsprogrammierschnittstellen oder andere Mittel der Interoperabilität, die von den Betreibern allgemein zur Verfügung gestellt werden („Drittanbieter-APIs“), die LISA CRM nicht kontrolliert. Drittanbietervereinbarungen und Drittanbieter-APIs (sowie die Richtlinien, Bedingungen und Regeln, die für Drittanbieter-APIs gelten) können jederzeit geändert, ausgesetzt oder beendet werden. LISA CRM haftet nicht für solche Änderungen, Aussetzungen oder Beendigungen. Sie sind dafür verantwortlich, sicherzustellen, dass Ihre Nutzung der Dienste im Zusammenhang mit einem Drittanbieterdienst allen Vereinbarungen, Richtlinien, Bedingungen und Regeln des betreffenden Drittanbieterdienstes entspricht.

No unlawful or prohibited use

As a condition of your use of the Service, you will not use the Service for any purpose that is unlawful or prohibited by this Agreement. You may not use the Service in any manner that could, in our sole discretion, interfere with, damage, overburden, impair or disrupt any other party's use of the Service. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Service. In addition, you agree not to use any false or misleading information in connection with your account and acknowledge that we reserve the right to disable any account with a profile that we determine (in our sole discretion) is false or misleading (including a profile that impersonates a third party).Improper or Prohibited Use

Modification and termination of services

LISA CRM reserves the right to modify, update or discontinue our Services, or any part thereof, without prior notice. You agree that we may suspend or terminate your right to access our Services at any time without notice, obligation or liability to you if you breach the Terms.

Sie können diese Vereinbarung auch jederzeit aus jedem Grund oder ohne Grund kündigen, indem Sie Ihr Konto über den Dienst löschen und/oder uns eine E-Mail an support@lisacrm.de senden, um Ihre Daten zu löschen.

Limitation of liability

To the extent permitted by law, you agree to indemnify and hold LISA CRM and its affiliates, employees and partners harmless from all claims, liabilities, damages (actual and consequential), losses and expenses (including attorneys' fees) arising out of or in any way related to claims by third parties in connection with (a) your use or misuse of the Services (including actions by third parties using your account); (b) errors in the content or interruptions of the Services; (c) personal injury or property damage of any kind resulting from your access and use of the Services; (d) unauthorized access to or use of our servers and/or any personal information and/or financial information stored therein. In the event of any such claim, action or proceeding ("Claim"), we will attempt to send the Claim to the contact information we have on file for your account (provided that failure to serve such notice will not eliminate or reduce your obligation to indemnify us hereunder).

Arbitration agreement

Any dispute arising out of or in connection with this Agreement, including any question as to its existence, validity or termination, shall be finally settled by arbitration in Singapore in accordance with the arbitration rules of the Singapore International Arbitration Centre ("SAIC Rules") then in force and such rules shall be deemed to be incorporated into this clause.

The tribunal consists of one arbitrator and the language of the arbitration is English.

Applicable law and place of jurisdiction

This Agreement shall be governed by the laws of Germany, excluding its conflict of law rules.

Your data may be processed, stored and used outside the country in which you are located. Data protection laws vary by jurisdiction and different laws may apply to your data depending on where it is processed, stored or used.
